About the DBA Act
The DBA Act (Deregulation of Assessment of Employment Relationships) was introduced in 2016 to tackle false self-employment.’In short, the law is intended to prevent self-employed professionals from actually working as if they were employees.’Both the client and the self-employed professional are responsible for assessing whether there is a genuine assignment contract or disguised employment.
False self-employment can have major consequences. Think of additional taxes, extra premiums and fines. Yet in practice, the current DBA Act is complex and creates a lot of confusion. That is why new rules will come into effect in 2025. What do these changes mean, and how can you anticipate them? Find out below.
Changes for self-employed workers
The rules of the DBA Act remain the same, but both contractors and self-employed professionals will have to comply with them more strictly from now on. This is because the Tax Authorities will check more closely. The focus is not only on the assignment contract, but especially on how the assignment is performed in practice.
As a self-employed professional, you must be able to prove that you are truly self-employed and that you meet the requirements of the DBA Act. This means your administration and documentation must be fully in order. This way, you avoid problems and can continue working according to the rules.
Solutions for self-employed people

From 1 January 2025, employers will have more responsibility when hiring self-employed workers. They will have to check whether they are truly self-employed and not in a disguised employment relationship.
In case of false self-employment, employers run the risk of substantial additional taxes and fines. In addition, it is important that all records are in order to demonstrate compliance with the DBA Act. This may require extra work, but prevents problems in the long run.
